The general conditions of sale apply exclusively to current and future commercial relations concluded on the one hand between:

By any natural or legal person making a purchase via the Foxis.fr website, hereinafter referred to as "the buyer" or the "customer" or "You". Any condition not in accordance with our general conditions that You have formulated will be rejected unless We have expressly and in writing recognized their applicability.



Price / Products

Some products require you to be of legal age, when purchasing this type of product, you must certify that you are over 18 years old and accept the following general conditions of sale. In addition, the buyer takes full responsibility for the use of the products purchased.

Prices are quoted in euros all taxes included. The items We sell are described and presented with the utmost accuracy. The photos, texts, information or characteristics of the products appearing in the catalog are not contractual.

If, despite all our precautions, errors may have occurred, We could in no case be committed to this fact. Except in the event of a warranty, any operation between FOXIS and its customers, not contested within 3 weeks, cannot give rise to a complaint.

The product and price offers are valid as long as they are present on the Foxis.fr website, while stocks last. In case of unavailability of products after placing the order, the customer will be informed by e-mail or by telephone or letter. The seller will offer to replace the product ordered with a similar product. In the absence of acceptance, the order will be canceled; in the event that the payment has already been cashed, the customer will be reimbursed within a maximum period of 30 days.



Delivery method

Your order will be delivered to the address you gave us when ordering. The price of transport will be automatically calculated and updated according to the delivery method, the item and the delivery location selected in your basket.
For areas outside Europe, customs or import taxes are due as soon as the package reaches its country of destination. You will then have to pay any additional customs clearance taxes. The seller, having no control over these taxes, cannot predict them. For more information and accurate pricing, please contact your local customs office.

The announced delivery times are the average times observed with recognized carriers such as La Poste and GLS and we cannot be held responsible for any delay by the carrier in relation to the announced times. These deadlines start from the processing of your order by our logistics department, any order in stock placed and paid before 12 noon being processed and shipped the same day. In accordance with the Châtel law, we inform you that the delivery deadline is 30 days after receipt of your payment.



Payment methods

Payment of your order in 3 or 4 installments by credit card from 100 € of purchases up to 3,000 € with Oney Bank.
Our partner Oney Bank offers you a financing solution called 3x 4x Oney, which allows you to pay for your purchases of € 100 to € 3,000 in 3 or 4 installments with your bank card.

Conditions : This offer is reserved for individuals (adult individuals) residing in France and holders of a Visa and MasterCard bank card with a validity date greater than the duration of the financing chosen. Systematic authorization cards, in particular of the Electron, Maestro, Nickel, etc. type, as well as e-cards, Indigo and American Express cards are not accepted.

You read the general terms of payment in several installments to which you wish to subscribe which are provided to you in PDF format so that you can read them, print them and save them before accepting them. You then notify your electronic acceptance by the corresponding checkbox.
You acknowledge that the "double click" associated with the checkbox on becoming aware of the general conditions constitutes consent to contract and constitutes an irrevocable and unreserved acceptance of the general conditions of the product. Unless proven otherwise, the data recorded by Oney Bank constitutes proof of all transactions between you and Oney Bank.
If you request to benefit from a financing solution offered by Oney Bank, the information relating to your order will be transmitted to Oney Bank, which will use it for the purpose of studying your request for the granting, management and credit recovery. Oney Bank reserves the right to accept or refuse your request for 3x 4x Oney financing. You have a 14-day cooling-off period to give up your credit.

Operation : Payment in 3 or 4 times by credit card allows you to pay for the order made on our merchant site as follows

                        - a mandatory contribution, debited on the day of confirmation of the shipment of your order corresponding to a third or a quarter of the order, to which are added costs corresponding to 1.45% of the total amount of the order for a 3 times and at 2.2% for 4 times (within the limit of € 15 maximum for payment in 3 installments and € 30 maximum for 4 installments);

                        - two or three monthly installments, each corresponding to a third or a quarter of the order, taken 30 and 60 days later for the 3 times and 30, 60 and 90 days after for the 4 times.

Example: For a purchase of 150 €, contribution of 52.18 € then 2 monthly payments of 50 €.
Credit for 2 months at a fixed APR of 19.31%. Cost of financing: € 2.18 within the limit of € 15 maximum.

● Payment in 4 installments from € 100 of purchase and up to € 3,000
Example: For a purchase of € 400, contribution of € 108.80 then 3 monthly payments of € 100. 3-month credit at a fixed APR of 19.61%.
Cost of financing: € 8.80 within the limit of € 30 maximum.

Transport information

Delivery will be made by our carriers, in areas delivered by FOXIS. Delivery is made by direct delivery of the product to the announced recipient, or, in the event of absence, to another person authorized by the customer. For reasons of availability, an order can be delivered in several times to the customer.
The customer only pays for one delivery. If the customer wishes two places of delivery, he places two orders, with the associated delivery costs. The following are considered as force majeure releasing the seller from his obligation to deliver: war, riot, fire, strikes, bad weather, accidents, the impossibility of being supplied, all other natural disasters even if the conditions of unpredictability and exteriority are not met.



Transfer of ownership

The transfer of ownership of the goods to the benefit of the customer is suspended until full payment of the price. In the event of deferred payment, Foxis.fr will retain ownership of the goods until full payment for them under the contractually established conditions, even in the event of collective proceedings opened against the customer, in accordance with articles L.621-122 and following of the trade.



Terms of delivery

In the case of standard delivery, bulky packages are not delivered upstairs but are delivered at least to the doorstep of the house or building. The times indicated on the site and in the general conditions of sale are average times. Exceeding delivery times may not give rise to damages, withholding or cancellation of orders in progress. However if after the delivery deadline the product has not been delivered, for any reason other than a case of force majeure described in the paragraph "Information relating to transport", the sale may be canceled, at the customer's request and this within 60 days, by registered letter AR. The seller will then return the payment to the customer to the exclusion of any other compensation or damages.

The seller reserves the right to cancel an order in the event of too great difficulty for the carrier to make the delivery.

If you are away from your home during delivery, a calling card is left in your mailbox with the carrier's contact details so that you can contact him again and make an appointment. Delivery is considered to have been made on the date of the first presentation of the order to the address indicated on the order form.

Upon delivery, the customer must ensure that the products have not been damaged during transport. If the customer notices an apparent anomaly, he can either accept or refuse the products. In both cases, he must report the said apparent anomalies on the carrier's delivery note and within three working days by registered letter AR to the carrier, and send a copy to Foxis.fr (73 rue Victor Hugo, 92400 Courbevoie (France)). In the event of delivery by postal services, the same precautions apply.

If an anomaly is found, an anomaly report must be completed by the customer. If the products have been accepted, the customer can contact our services in order to organize a return of the product according to the formalism described in the article below "satisfied or refunded". Copies of the annotated delivery note, the letter addressed to the carrier and / or the anomaly report must be attached with the returned product (s). If the products are refused, the customer must ask the carrier to return the products to the seller. Copies of the annotated delivery note, the letter addressed to the carrier and / or the anomaly report must be sent at the same time to Foxis.fr by registered letter AR.



Satisfied or refunded

If you have changed your mind within 14 days of your purchase

The legal withdrawal period is 14 days following the delivery of your order. If your return is accepted, your items will be reimbursed no later than 14 days after receipt of the returned product (to which must be added any interbank delays, ranging from 3 to 7 days).

An email is sent to you when your return has been registered and the refund has been set up by our customer service. In the event of an exchange or refund request, the customer returns the new item at his own expense in its original packaging, intact, accompanied by all possible accessories, instructions for use, documentation, purchase invoice. The first step is to contact us beforehand by e-mail (contact@foxis.fr) or by phone in order to obtain a return agreement as well as the address of the place of return.
Please note, any item returned without having contacted us first will be systematically refused.
If the item is returned incomplete or damaged to Foxis.fr, a discount in its price will be applied according to the diagnosis made by the after-sales service. Foxis.fr will justify the application of this discount to the customer by providing him with a document drawn up by its after-sales service.

In the event of exercise of the right of withdrawal, we undertake to reimburse you for your order, or to exchange products that do not correspond to your order (defective or non-compliant). In the event of a refund request, the refund will be made, according to your initial payment method, by transfer, check or credit card credit, as soon as the diagnosis of our after-sales service has been carried out.



Guarantee

In any event, the customer benefits from the legal guarantee of eviction of hidden defects (art. 1625 and following of the civil code). The guarantees do not cover:

  • non-compliance with the instructions given in the maintenance instructions.

  • any handling error as well as lack of maintenance of the product.

  • use not in accordance with the use for which the product is intended, and in particular use for professional or collective purposes.

  • to any cause of external origin.

In the event of a request for activation of the guarantee, the purchaser must contact the consumer service of the brand concerned directly. To be able to activate the warranty or the warranty extension, it is imperative that the purchaser has kept the original packaging of the product as well as the invoice constituting proof of purchase of the product.

Applicable texts / jurisdiction

This contract is subject to French law. The language of this contract is French. With the exception of individuals for whom the competent courts will be determined by the provisions of the Code of Civil Procedure, in the event of a dispute, the Grenoble Commercial Court will have sole jurisdiction. This attribution of jurisdiction will also apply in the event of multiple defendants or warranty claims.
